According to the prediction of Western Australia’s Chamber of Commerce and Industry, the state may face major skill shortages in coming times. The chamber forecast that Western Australia will require about 500,000 skilled workers in the coming 10 years. This makes the chamber to predict that the huge number of required workers will cause labor shortages in the state.

On the basis of available figures, as well as the current trend of population growth the chamber makes it a point that Western Australia will face a shortage of over 200,000 workers. Recently, Prince Edward Island, Canada made changes to its Provincial Nominee Program (PNP). With the implementation of new amendments, immigrants will find it easier to go through the program in order to meet the requirements needed to obtain residency in Prince Edward Island!

Earlier, individuals who intended to migrate to Canada under the PEI PNP Entrepreneur Stream had to deposit $25,000 as an evidence of good faith, along with the intention of settling in the province. However, the amount gets refunded, given the applicant had resided in the province for a year. As per the new amendment, this requirement has now been relaxed.

Also immigrant entrepreneurs whose proficiency in English or French, being the two officially accepted languages in Canada is insufficient were required to deposit an amount of $20,000, that to be returned after they demonstrated a certain level of language skills in either of the languages. With the changes to the PNP, the PEI government lowered the standard for the official language skills.

The PNP is a federal-Provincial partnership between the governments of Canada and Prince Edward Island. The program was introduced to accelerate immigration to Canada for individuals, as well as families who intend to settle in Prince Edward Island. As per the rules of the program, applicants must meet the basic requirement of having moderate proficiency in either of the two Canada’s official languages, English or French. PNP allows applicants to immigrate under three categories- (1) Skilled Worker; (2) Immigrant Entrepreneur; and (3) Immigrant Partner.

In a recent report, an American Couple won a Federal court case. Readers would be thinking as to what is so exceptional about winning a court case! The case could change the way the Canada government treats immigrants who are HIV positive.

Although Canadian Immigration laws do not openly ban immigrants with HIV positive coming to Canada, but having HIV is almost considered as an automatic refusal, on the grounds that the patients would compel major demands on the “health care” of Canada. The issue is a concern for people suffering from various health conditions.

Ricardo Companioni and his partner, both suffering from HIV, were initially approved to move to Canada under the Skilled Worker category. Their annual bill was prescribed somewhere around $33,500, on which the couple agreed to cover their own costs, provided they don’t get any insurance. The couple also showed a proof that they have half a million dollars in assets, but ended up as their case being rejected!

Companioni showed his astonishment and said that he was really shocked at being rejected at such a later stage. But on an advice form a Toronto lawyer, the couple decided to re-appeal. Courtesy the decisions by Justice Harrington’s decision, the case of the concerned American couple would be sent to another office for consideration!

The case might open the gates for all the immigrants suffering from HIV or any other health condition to move to Canada, provided they pay for their own drugs.

According to the Ministerial Instructions (MI), the new Operational Bulletin Number 173 has been introduced to elucidate the requirement of evidence for work experience in one or more the occupations mentioned in the National Occupation Classification. This bulletin has been put in to effect immediately.

The Operational Bulletin states that the all the skilled worker applicants under Federal Canada should have at least a year of full time work experience or equivalent in the tenure of the previous 10 years, which is paid. This is not restricted to only one specific occupation that is mentioned in National Occupation Classification. An applicant is permitted to have a combined experience of a year as well in different professions. With this, the Bulletin also demystifies the question of gaps between jobs for the applicants under the SW1 and SW3.

Previously, the eligibility included having a minimum of one year of professional experience which is full time and continuous in a specific profession. However, the amendment made now continues to mandate the same terms for professional experience but with a slight change. The applicant is no more restricted to work in the same profession. He could have worked in different professions continuously for a year and would still be eligible.

Now, the gaps between each employment which are not of long duration would be permitted. For instance, an applicant was employed in a contractual basis and seeks a new job before finishing his tenure. In this case, the candidate would have to join his new job shortly after his contract with his previous employer is over. The short period before joining his employer would be accepted by the Canadian High Commission. However, the occupations in both the cases must be present in the list of the MI. This is specific for both – SW1 and SW3 categories.

Additionally, those applicants who were deemed as ineligible would now be qualifying for the same. A follow – up operational bulletin would be issued for them. This bulletin is still in the process and thus, in the meantime these applicants would have to consult their specific Regional Program Advisor.

Immigrants in Canada who are not of English origin have always faced difficulty in landing with good job offers. These have also been proved by many Canadian research studies.

Today, discrimination by many biased Canadian employers is a matter of concern for the country. Many research studies have shown that non – Canadians with English names are more likely to get appointed for a job when compared to those of Indian, Chinese or of Pakistani names.

Metropolis – an Immigration and Diversity Research Group conducted a study by sending more than 6000 fake resumes as a response to different job advertisements in the Toronto region. The study showed applications with familiar English names had 16% more chances when compared only 11% chances for names of other nationalities. All these groups belonged to same level of education and work experience.

It was also found out that those non – English names with Canadian work experience but foreign education were even less preferred with only 8% rate of response. However, people with no Canadian work experience and foreign education had only 5% chances of getting a response from an employer.

With this, the fake resumes with additional skills, voluntary work experience and other extracurricular merits had better chances but still not to an extent where it could help much to an applicant.

This study is a clear example of why unemployment rate amongst the immigrants is higher (11.5%) when compared to the local unemployment rate (4.9%).
