USA has banned the adoption of abandoned kids from Nepal. It has been confirmed that the ban has been imposed; courtesy the increase in the number of child trafficking cases and incidents linked with fraud documentation cases.

Reports have confirmed that the ban is for indefinite period, but in some cases, the adoption may be performed where children were not abandoned but whose biological parents were eager or ready to abandon them. However, in such cases, it would be necessary to perform a DNA test on them which would be needed to prove the fact that they are their biological parents.

This step was implemented in order to protect the rights of the children from Nepal after it has been proved that the paper work used for the purpose of adoption as abandoned is mostly fake and do not have reliable evidences behind them. The same has been confirmed by a joint statement from the US Department of State and US Citizenship and Immigration Services.

Also, it has been confirmed that the birth certificates which are shown as proofs contain data which are tampered in a major way. Also, the orphanage records are not matched properly with the investigations of children. Even such cases are also seen where parents are in hunt of their child who has been displayed for adoption under the tag of abandoned child.

Also, without reliable documentation, it is not right for the US government to perform the tasks further. Hence, it was apt to ban child adoption from Nepal.

US recently has signaled of easing out its stance on the facet of hiking the professional work visa fee for the applicants from India who are intending to move from India. The recent refusal of visa application of one of the ex-staff of border security force by the Canadian High Commission in New Delhi has been roundly criticised and rightly so. It is not the refusal as such but the reasons for refusal that are the bone of contention. To call one of the Indian paramilitary forces engaged in “systematic torture” is preposterous and condemnable. However, it may be pointed out that a clarification has already been given to the Canadian High Commission. Also, that Canada respects Indian institutions and democracy and a review of the controversial refusal may be in order.

There are two issues that stand out clearly from this refusal. Firstly, the concepts of “Immigration” and “Visa” are often used by Governments across the world to make political statements for another country. They are at times used as weapons for diplomatic negotiations. For instance, China does not issue visit visas to the residents of Arunachal Pradesh as the nation feels that this Indian state is actually a part of China. Thus, they do not a need visa to visit their homeland. Similarly, even the Indian Government has been known to be tough on issuing visas to leaders of so-called free Kashmiri movement.

Secondly, the refusal highlights the discretionary powers that a visa officers exercises in the overall decision making process. Prior to stamping, he was called for an interview which is not a standard process any more. Post this interview, his application was rejected. But most times, the applicants are not even given an opportunity to present their case through an interview. Where an interview is indeed taken (for instance, USA), the applicant gets 1-3 minutes for a decision to be taken by the interviewing officer. The file that he has painstakingly prepared is not even looked into. The decision is based on how the applicant talks and walks or if he gets nervous. Why should all the High Commission and Visa Posts retain the fee of the applicants whose visit visa applications have been refused?  Is it not true that the visa posts of the popular destinations like USA, Canada, UK, France etc. are major money making machines for these Governments? If visa officer’s discretion is what is going to decide the acceptance of an application, then why not take a minimum administrative fee in the first instance and take major part of application fee if the case is approved?

Long term reforms are in order on the discretionary factors related to visa approvals. That is the only sure shot strategy to ensure that incidents related to the above do not occur again.

It simply adds to some amount of confusion regarding where we stand. I am sure that these two (and hundreds of other rich people) do lot of philanthropy. But what is the logic for such inequitable income among poor in India and the world population in general? How can the world work together to have a more happy and satisfied souls and less of hungry and crying people around us?

Also to think of the burden that these rich face is something to think about. I am sure they want to do a lot for the poor and hungry. But how fair is the world in expecting them to subsidise their happiness for something which is not their responsibility in the first place? If the rich are to support all the hungry people, where is the motivation for them (poor and hungry) to work hard climb the ladder on their own? And these rich people pay millions in the form of taxes to the Government in the hope that these taxes would be used for the benefit of people at large. By paying taxes, have they not fulfilled their duty to the nation and its people?

On a lighter note, how does it feel to be so rich? I cannot even think of what their feelings are? Is it not true that they have to work harder to overachieve themselves and continue to be rich, year after year? Does that not make them tired and unhappy? Do they manage to take out time for themselves and families? Some interesting questions!
