The immigration debate has spread all the way to Florida. The Republic Attorney General of the state intends to bring about a new legislation which would give the authority to the police officials to check the immigration status of the suspects. With this, the undocumented migrants would be subject to longer imprisonment terms.
These laws are beyond what has been put forth in Arizona. However, the federal court has put on a stop on some of the points in the law to be executed. Twenty more states are thinking on laws similar to that introduced in Arizona. According to Bill McCullum who is campaigning to become the next governor of Florida, this law would mean a great deal for public safety. The law would cater to new tools for enforcement which would protect the citizens and fight illegal immigration.
This law needs the police authorities to check on the immigration status of those arrested to know whether the person is residing in the nation legally or not. This could now be done as a daily chore which is otherwise done by the immigration officials.
With the implementation of this law, the companies operating in the state would have to use an electronic system which would enable them to check whether or not their recruits are legal residents.
As of now, there are more than 10 million undocumented migrants living in the United States. This is going to be one of the burning issues in the soon to be coming midterm elections.

According to the Sunshine State Survey brought out by Leadership Florida, jobs and economy are the top ranking issues for the people of Florida. It seems that it is hard for the politicians to realize who seem to be obsessed with illegal immigration. In 2008, when the Floridians were asked about their most important concern, about 56% of the respondents pointed to economy and jobs. There was not even a single respondent who selected immigration. In 2010, 43.7% agreed to the same. However, the change was that about 3% opted immigration as their top most concern. Despite the above survey, the immigration bill introduced in Arizona seems to be the key point of discussion.
The GOP candidate for governor, Attorney General Bill McCollum has chalked out his own bill only as a proof that he is equally competitive in this regard. However, this too has come out after months post the Arizona bill. At the same time, McCollum’s opponent, Rick Scott agrees to the Arizona-style bill. And so, there is an apparent flip-flop.
Despite churning out such a bill, the question that arises is who can be considered as a suspected illegal immigration. Since the key points in the Arizona law has been blocked by a federal judge, the same might happen in case of McCollum.
Above all, whatever be the issue it is the fear which tends to dominate here. This is because more needs to be done in this regard. An approach which is more focused and addresses the issue which higher chances of being a success is what that is required here.

No matter how people across the United States are oppose the latest Arizona’s immigration law, which takes its effect on July 29, 2010, lawmakers in as many as twenty other states in the US are in favor of introducing similar legislations. Even though, lawmakers in states like Florida, Idaho, Minnesota and Nebraska are all praise of the Arizona’s controversial law, they are still reviewing the challenges that such a law could face. They are yet to know if boycotts over the law would hurt the state’s economy!
The soon-to-be come into force immigration legislation in Arizona caught the criticism of various groups, as it requires the state’s police to perform immigration checks on anyone, and question his/her immigration status, if they suspect that the person is inside the United States unlawfully. Moreover, any illegal outsider would be entitled to a jail sentence of 6months; a fine of $2,500, as well as federal deportation from the country.
Reportedly, in a few US states, similar immigration legislations have been introduced, however, they are yet to take their effect. And none of the legislations will see its implementation in 2010. Pennsylvania, Minnesota, Michigan, Rhode Island and South Carolina are the states which already have such an immigration law in their agendas. Of late, lawmakers of other eighteen states have expressed their willingness of introducing Arizona-like immigration law. The number of US-born foreign people is growing over the recent years. According to reports, the immigrant population in the nation reached about thirty-eight million in the year 2008. The number constituted for about 12 percent of the United States’ total population. Besides, it is more than the total population of Canada. It clearly indicates how fast the immigrant population is growing in the US in recent years and this also crops up the issue how it affects the nation as a whole!
When we think about the affects of the growing number of immigrant population, many things come to our minds. One of those is the newly implemented Arizona bill. Many tend to think that, is increasing number of overseas-born population is a contributor to the growing tension over illegal immigration in Arizona, which eventually led to the controversial new legislation in the state? This also makes us think are all states in the US experiencing similar growth? As a result, are we expecting similar tensions all over the nation in coming days?
Apparently, Arizona is not one of those states in the United States, which have the most foreign-born residents. But, of late the state has witnessed some of the most unexpected increase of foreign born people since 1990. This has made Arizona’s population (foreign-born) to go over 900,000 from less than 300,000 over twenty years. This might be one of the reasons why the voters in Arizona agreed to vote for a law that has been criticized on large scale of late. And the law has been stimulating racial discrimination in the state.
Besides, California happens to be the state that has the highest number of foreign-born resident. Twenty-seven percent of the state’s total population, which accounts for nearly 10 million is born outside of America. Other states with large numbers of foreign-born residents include New York with 4.2 million; Texas with 3.9 million; and Florida with 3.4 million.

An operation was carried over three days in the Southeast of United States aimed at foreigners who were accused of indulging in criminal activities. Five hundred and ninety six immigrants were arrested by Federal Agents who were found to have records that were criminal in nature. This was the biggest operation ever conducted for such a sweep in the Southeast as per the officials.
The US Immigration and Customs Enforcement termed it as the “Operation Cross Check” and is the largest agency to have carried out such an operation which was aimed at convicts. Those criminals who were convicted and have served their sentences are being tried to be deported.
Four hundred federal agents and law enforcement officials were involved in this sting operation. Convicts were caught from Florida, North and South Carolina, Arkansas, Georgia, Louisiana, Alabama, Puerto Rico and Mississippi.
As per the officials, the convicts were not targeted based on their nationality. Those arrested belonged to sixty different nationalities which consisted of Asians, Latin Americans, Eastern Europeans, the Middle East and Africans and so on.
These immigrants would most possibly be deported or would be subject to a hearing. However, the prosecutors might press charges against around twelve of these convicts arrested due to their previous immigration records pertaining to arrest. The arrested could be sentenced for up to 20 years of imprisonment if found to be involved in re-entry into the nation illegally.
Additionally, there were three of them who were charged with murders, the sex offenders consisted of another twenty six and drug charges were impressed on more than two hundred and fifty. As per the officials, these convicts were targeted because of their likely chances to commit crimes again.

Two Florida women have been arrested last Wednesday who are alleged with running a student visa fraud ring. The defendants are charge with misleading the US government while granting student visas to over 200 overseas nationals, who were actually not students. The U.S. attorney for the Southern District of Florida and special agent in charge for ICE Office of Investigations, Miami Field Office reported the case on Thursday.
According to the panel formed for the case, the foreign nationals who had been issued the U.S. student visas were falsely enrolled in the Florida Language Institute, 947 SW 87th Avenue. Post 9/11 attacks, it is a major issue for the nation, since many terrorists involved in the terror attack were holding students visas, but they all misused the visas. It was also reported that some attackers, including the pilot Hani Hanjour entered the U.S. as a student for language courses, but he never attended any class.
The 9/11 attacks had spread terror to such an extent that immigration officials have become very cautious and started monitoring schools that enroll overseas students as to whether they are attending their courses or not. However, the Miami case does not necessarily have to do with terror activity, but of illegal immigration.
The accused Lydia Menocal and Ofelia Macia, the school’s employees, however, defended themselves that the petitions that were signed by them were actual visa requests for the students. The investigators are trying their best to find what the foreign nationals with student visas were actually doing in the U.S.!

The American Bar System has finally knocked the Congress to revamp the present system for immigration. The alternative should have new and independent courts for the cases pertaining to immigration. This move came about after much pleas and requests from the immigration attorneys and judges. According to the immigration lawyers, the courts in the United States is stumbling upon the weights of the pending cases which tends to rise in its numbers at all times.
During a semiannual meeting in Florida, the lawyers’ organization agreed as part of the vote on a recommendation for a completely independent system of court which is similar to the tax deciding federal courts. The main reason behind such a vote is the constant rise in the number of cases dealing with illegal immigration. The condition of the courts was discussed extensively in a report which was brought out recently.
It has to be noted here that the immigration courts in questions are not at all similar to what it is presumed to be. These courts are not under the federal judiciary and instead are a subsidy of the Department of Justice. The judges conducting are not the actual judges here. They are the employees of the attorney general.
Since 2006, the issue of legalizing all the illegal immigrants has been much talked about. In the meanwhile, the issue of courts has been out of focus. These courts have now become clogged with the entire backlog to such an extent that only an explosion would give it some space to breathe.
According to the 2008 Bar Association Report, around 378,582 immigrants were detained by the officials of the Homeland Security. Off these, more than 358,000 were deported back to their home country. The case was similar last year as well with a total of two hundred and thirty one judges conducted more than 300,000 cases which is thrice the usual load of work for a federal district judge. It is but obvious that these judges are being tested beyond their patience which would simply leave them frustrated and overworked.
Additionally, the asylum cases have made the situation even more complex. The main reason is the fear of violence in the minds of the immigrants after they go back. To this respect, the report stated that there is an increase in the number of immigrants waiting for their turn to come about for a hearing. This has led to the increase in the number of appeals for the decisions made.
All in all, actual immigration reforms are yet to be seen being executed by the Obama administration.
