EB5 visa is part of the US migration policy that provides immigrant visa to intending investors to come, invest and reside in US. The permanent residency under EB5 is availed after the applicant has successfully complied with the necessary requirements.
As per the guidelines made by the United States Citizenship & Immigration (USCIS) the immigrant needs to first make an investment of $500,000 in any of the commercial entities within US. The commercial entity could be a private firm, partnership firm, Proprietary firm or public firm. Apart from the initial investment, 10 direct jobs should also be created out of the investment. Once the conditions are observed a conditional EB5 visa is issued to the investor for a period of two years. The visa covers the investor, spouse and the children upto 21 years old. Upon a successful compliance of the said condition for a period of two years, the investor would be given permanent residency in US under the EB5 visa. The investor is now at par with any of the US citizen for his rights as a resident of US.
Also, the investor should make sure that the ‘source of the investment’ is legal. At the time of application the investor is required to also submit the financial records that substantiate the validity of the source. The employment details, salary receipts, income tax declarations, sale deeds, sale contracts and papers relating to inheritance can be submitted for the purpose. The objective with the immigration policy is to make sure that any immigrant coming to US makes an active contribution to the development of the state. As part of the economy the residency under EB5 visa is considered an US citizen.
