Resident Visa with Conditions- Skilled Migrant Category!

Sometimes, a New Zealand resident visa is issued to foreign nationals under the Skilled Migrant Category which is subject to conditions, set by the NZ Immigration Act under its Section 49(1). Below are the circumstances under which a principal applicant, as well as accompany applicant, including partner and dependent child are issued with resident visas subject with conditions:

When a principal applicant under the Skilled Migrant Category is issued with a NZ resident visa on the basis of points he/she earns for a skilled employment offer in New Zealand or current skilled employment in the country for fewer than 3 months, the resident visa is subject to the below mentioned conditions:

  • The principal applicant who has a skilled job offer must take up that job within 3 months after his/her entrance in the kiwi country as a resident (in the case it was issued to the applicant outside NZ); or after issuance of the resident visa (in the case when it was issued in NZ); AND
  • The principal applicant must remain in the job for a minimum period of 3 months; OR
  • The principal applicant who has current skilled employment in the Kiwi country for less than 3 months must remain in the job for a minimum period of 3 months; AND
  • The principal applicant must inform the INZ of his residential address and any further changes to it; AND
  • The principal applicant must submit evidence to INZ that within 5 years of his/her first entry to the Kiwi country as a resident (in the case the visa was granted outside NZ); or the grant of the resident visa (in the case when it was granted in the Kiwi country), the aforementioned conditions have been fulfilled.
