Breach of Sponsorship Undertakings – New Zealand Residence Class Visa

If a New Zealand citizen or Residence Class Visa holder is sponsoring a non-resident under the Residence Class Visa category, the sponsor is entitled to some sponsorship undertakings. As we have already discussed them in this series, let us discuss what happens when sponsorship undertakings are being breached:

  • The sponsorship undertakings are said to be breached if the costs of any portion of the maintenance, accommodation or outward traveling are incurred by the Crown or a third party.
  • When costs are incurred by the Crown or a third party, owing to the sponsor’s denial of paying for the same- (a) the Residence Class Visa holder is considered to have violated the conditions of the visa and as a result of which he/she is entitled to deportation from New Zealand; (b) the unpaid costs are considered to be the debts of the sponsor, therefore the sponsor is answerable or pursued by the Crown of the third party.
  • A sponsor of the New Zealand Residence Class Visa holder is liable for the debt incurred to the Crown or a third party even after the end of the sponsorship period, of course, till the time the debt is recovered. Moreover, the sponsor’s liability does not over regardless of the subsequent status of the sponsored person or the departure of the sponsored person from the Kiwi land.
