An individual holding a New Zealand residence class visa or a NZ citizen who adopts a child from outside the Kiwi country, he/she can apply on behalf of the child for NZ citizenship or NZ residence. Below is the citizenship procedure one has to follow for children adopted overseas:
- The discretion to determine whether an adopted child will be grant New Zealand citizenship or not is owned by the Department of Internal Affairs, which administers the country’s Citizenship Act 1977.
- The adoptive parents or the New Zealand citizens or residents are required to apply to the Department of Internal affairs or the concerned overseas post to determine the citizenship of the adopted child.
- Grant of citizenship to an adopted child is dependent on whether or not the adoption process satisfies the requirements under the Section 17 of the Adoption Act 1955.
