Court Denied the Stay of Disabled Child in Canada

A family has been disagreed a Permanent Residency Status in Canada as their daughter was suffering from cerebral palsy.

Rachel is seven years old and is disabled with cerebral palsy, a disorder which leads to the motor dysfunction in the whole system. Her father David Barlagne, along with mother Sophie and Sister Lara emigrated from France in the year 2005.

According to a spokesman for Jason Kenney, Immigration Minister of Canada, the clan can still apply for a visa on humanitarian levels, but still one cannot assure whether they would be accepted or not.

It has been reported that the Federal Court denied the French man’s appeal to get a Permanent status for his entire family, as his daughter would bring out a lot of burden on the nation’s medical system. She was applauded as “medically inadmissible” for Canada.

Barlagne stayed in French island of Guadeloupe before coming to Montreal five years back on a work permit. He was given assurance that Montreal would be a great place to commence a business in computer software. The family went on to settle down here and Sophie moved ahead to teach French to people in the country. But now, the family has been ordered to move out of the nation as soon as the work visa expires, courtesy his daughter’s medical condition.

Hence, the family followed the path of seeking judicial review for their case, but received a negative response from the court.
