Grandparents and legal guardians are considered to be eligible for New Zealand residence under the Parent Category, however, both the parties, applicant(s) and sponsor must meet certain requirements.
- A principal applicant and their partner are regarded as the parent(s) and the sponsor is regarded as an ‘adult child’ under Parent Category if:
- (a) The parents of the sponsor died before he/she became 20 years old; AND
- (b) The principal applicant had held the sponsor’s legal guardianship before the latter had become 20-year-old. The guardianship can be either the sponsor’s custody; or the responsibility to look after the sponsor.
- A grandparent and his/her partner will only be regarded as parents, and the sponsor himself/herself will only be regarded as an adult child under the Parent Category, given both the parents of the sponsor are deceased.
- The Parent Category allows a New Zealand citizen or resident to sponsor only one of his/her grandparents and his/her (grandparent’s) partner.
