According to the reports by a US policy research group, an Indian citizen with higher skills sponsored now for the skilled employment visa could wait for 70 years to obtain a Green card.
The National Foundation for American Policy concluded that by exempting students from overseas nations with a higher degree in science, engineering, technology or mathematics, from the quotas of green card, they will be able to keep the skilled individuals from leaving the US.
It would provide some significant benefits to the U.S. companies and to the economy of the country as a whole. The Family and Employment-Based Immigration System of America follows one simple rule, which is Keeping Talent in the Country and Waiting and More Waiting.
It is found that majority of the immigrants under employer-sponsored visa are either from India or China. But due to the limitation on the number of immigrants from such countries to US, the waiting time have become the longest. It limits the number of green cards issued to one country to 7% of a preference category.
According to this rule, yearly, less than 3,000 Indian nationals are issued with green cards in the employment based third preference (EB-3). There are 210,000 backlogs among professionals from India in this category.
The report mentioned that though there were half of the largest backlogs regarding Indian nationals in EB-3, but still the time of waiting for Indian nationals sponsored at present in this category would exceed 30 years.
However, Chinese immigrants sponsored now in the EB-3 category, could wait for two decades period. Immigrants from other overseas nations would probably have to wait for the period of 5 years or more.
For a newly sponsored immigrant from India or China, the waiting times in the EB-2 category would be from the period of 6 years to 8 years, but immigrants from other countries don’t need to wait in this respect.
Stuart Anderson, Executive Director of NFAP said that ability to wait for longer period of time is not in their interest to have as the most important feature for American immigrants.
