Temporary Foreign Workers In Canada — Know Your RIGHTS!

Canada is a magnificent country to work – but rights and freedom play an equally important role too! Hence, the fact becomes of uttermost importance for any temporary foreign worker working in Canada to know the rights decked with his employment. Have a look:
Your employer:

  • May give you the mentioned dues for your work
  • Must make it sure that the workplace you are working is safe
  • Has NO right to take your passport or work permit from the employee

Every province in Canada has an office which caters to the laws governing to employees and workers. You can visit the office and have an idea about your fair pay, hours of employment, and safety factors at workplace, including other conditions and facets.

What is written in your Employment Contract?

Depending upon the nature of your job, the contract should include the following aspects:

  • All the details of your job
  • Conditions of the job/employment you would be working into (which include the number of working hours, your salary including other benefits and reductions, overtime, leaves entitled to you and other things. Ensure that both employee and employer agree to the terms and conditions and a carbon copy of the same is enclosed with both the parties.
  • The contract should also mention money deducted out of the pay, for example Employment Insurance or money given to Canada Pension Plan.

What happens if you lose the job?

  • Usually a written notice should be provided to the employee before he tells you to quit the job. Additionally, if notice is not given, termination pay is paid to the employee.
  • If the contract ends, then the employer needs NOT to give you notice or termination pay.

Also, each province has difference set of rules for employees.

Know about HOUSING under your EMPLOYMNET CONTRACT

The employee can NOT demand for housing options until and unless they:

  • Work as a temporary farm worker the Seasonal Agricultural Workers Program or
  • Work under the category of a live-in caregiver under the Live-in Caregiver Program.

Know the deductions in your pay scale if you are being given food, room or board or all. Everything must be mentioned in the contract or cleared from the employer.

Health and Safety

  • Laws are made to ensure the health and safety of the employees, hence protecting them from any danger too. Different provinces cater to different laws.
  • In a majority if cases, employees have the right to refuse to the work if they find the element of danger in it. The employer has NO right to punish for the refusal.

HURT/INJURY at work:

Compensation benefits are provided to the workers if they are injured at work. Additionally, wage benefits like medical claims are provided if the employee is hurt of made sick by the nature of the job.
