- He is a citizen of a Commonwealth country and because one of his grandparents was born in the UK
- His stay in the UK is not subject to any conditions or time limit.
Apart from the above-mentioned situations, there is one more situation under which a migrant does not have to apply to the point-based Tier 1 (Entrepreneur) visa. It is when he is a Turkish citizen. He will have to apply under the European Community Association Agreement with Turkey.
