Tucson Police Official Challenge Dismissed!

A challenge which was filed by an officer from the Tucson police has been dismissed by a Federal District court. This challenge was against the new immigration law which has been introduced in Arizona. According to Susan Bolton, the U.S. District Judge, Martin Escobar, the Tucson officer does not possess the legal standing which would permit him to sue as per the documents of the court.

This lawsuit is one of the many that have been filed against this immigration law. In July, the Justice Department was successful in mounting a challenge on this law. While the law was to be implemented, Judge Bolton blocked certain key points from being implemented which were supposed to be the most controversial parts of the law.

This meant that the police was not permitted to question people regarding their immigration status. This was the key feature which made the law extremely controversial as the police was given the authority to detain people based on suspicion and immigration status.

The above were blocked and it was made a crime if one fails to carry or apply for alien registration papers. This also includes for an alien who is not authorized to solicit to work or apply for work. With this, another provision with enabled the arrest of people without any warrant and mere based on suspicion and to be deported has also been blocked.

However, the rest of the law has been put into effect. This involves banning of sanctuary cities along with hiring day laborers to be criminalized. These include those laborers who are residing illegally in the nation.

When it came to the dismissal of the Tucson officer challenge, the Governor of Arizona Jan Brewer was happy with the decision being taken.
