Challenge by Governor Brewer Rejected by Judge!

The controversial immigration law introduced in Arizona has had many lawsuits filed against. The recent news is that a lawsuit which has challenged the constitutionality of this law is going ahead after it was thrown out by a Federal Judge when Governor Jan Brewer along with others posed a challenge.

Susan Bolton, the US District Judge has dismissed the motions that have been filed by the Governor along with Joe Arpaio, the Maricopa County Sheriff and Paul Babeu, the Pinal County Sheriff. These motions were termed as being insufficient.

The lawsuit was filed by the American Civil Liberties Union and other organizations. As per the judge, there were merits in the claims made by these organizations. It was claimed that certain sections of the law might violate the 4th Amendment. As per this amendment, it is forbidden search and seizures without any reason. It also violates the 14th Amendment which does not permit racial discrimination and inequality among different classes of people.

This law has been put on a stay since July which made Judge Bolton decide that the complainant’s request for an enjoinment was arguable. Also, a separate lawsuit filed by the Justice Department. The hearing for the stay would be on 1st November before the Ninth Circuit of Appeals in San Francisco.

However, the judge did permit several motions which were presented by the governor. The law was signed by Governor Brewer in April. This law permits the police to check the status of an immigrant and could be detained on grounds of suspicion.
