New Zealand Resident Visa Holders Applying for a Permanent Resident Visa- All may not be eligible!

When it is a known fact that New Zealand resident visa holders can apply and obtain the country’s permanent resident visa, however, by meeting certain requirements, the lesser known fact is that all and every resident visa holder are not eligible to be granted with a PR visa. To be precise, in most case, people eligible for residence in New Zealand are initially granted with a resident visa and after that the process for permanent resident visa starts, for which an applicant has to meet the commitment to New Zealand requirement. It So, who are the resident visa holders that are not eligible for a permanent resident visa? Let us discuss:

  • Individuals who are ineligible for a visa under the Section 15 and Section 16 of the New Zealand Immigration Act 2009 are ineligible for a permanent resident visa. The only provision they are left with in such a situation is that they can apply for a variation of their travel conditions included on their resident visas.
  • Individuals who would otherwise be ineligible to enter the Kiwi land or for grant of a New Zealand visa if that were not for their NZ resident status are not desirable for a permanent resident visa. In such a case, an individual is entitled to apply only for a 14-day variation of travel conditions on his/her resident visa.
  • Individuals who are subject to deportation from New Zealand are not acceptable applicants for permanent resident visa. In certain circumstances, an individual may be granted a PR visa by special direction.

Note: When a resident visa holder’s application for New Zealand permanent resident visa is declined, the person is assessed under the instructions for a variation of travel conditions or a second/subsequent resident visa. If the person is eligible for a variation of travel conditions or a second/subsequent resident visa, he/she is granted with the apt variation of travel conditions or second/subsequent resident visa instead of a PR Visa.
